Newsflash: Help Needed: HOA Declarations Scandal and Road Maintenance Nightmare in NC, Now They Say We Can’t Rent Out the Rentals We Built

I’m seeking advice on issues from my property purchase in North Carolina nearly 9 years ago. Recently, I discovered that the HOA declarations provided at closing were unsigned, unrecorded, and unenforceable, yet accepted by the realtor, title company, and closing attorney. The real recorded declarations had expired 3 years before our purchase.Since then, we’ve struggled with our HOA to maintain a long gravel mountain road with crumbling culverts and poor drainage that has continuously eroded our property. Now, they claim to enforce the original unrecorded documents, which could put us in violation of non-rental and minimum square footage requirements.
